[‘LGC’, ‘we’, ‘us’, ‘our’]
For the purposes of this Declaration, you are any contractor, freelancer, in-house writer, member of staff or intern [any of the ‘Writers’] working with, at or for LGC and referred to in this Declaration as a ‘you’ ‘I’, ‘my’ or ‘me’.
For any of the Writers who are in Contract with LGC, this Declaration acts as a supplemental.
Under Contract, Writers have Agreed:
The Contractor undertakes that they will provide the personal services of ‘Full Name’ who agrees to adhere to any general and basic instructions at LGC pertaining to company formalities, the work Brief/s and to a schedule that will provide LGC with the Works during a time-line that will be agreed and outlined in any Brief or via e-mail or herein. The Contractor will not subcontract the work out to any other person or company or entity [including but not limited to any AI programme/s] unless it is first agreed by LGC.
Declaration of Original Work
Original Work
In reference to the Works as they pertain in Contract, you declare that the work provided to LGC constitutes original work and is not the result of anything generated by any AI LLM [‘Large Language Model’] including but not limited to ChatGPT. You declare the work produced in any form and in any medium for LGC [including for the clients of LGC] has not been created via sub-contract to any other person or party or LLM.
Breach
If it comes to pass that you are in breach of Contract namely in reference to what you are being asked to make known in this declaration then you acknowledge that LGC have the right to audit and in circumstances which leads to any certain breach, withhold monies said or contracted to be owing and that LGC can action legal means to collect back via refund for any monies paid where the services provided have been created by any LLM.
Understanding
You understand that LGC are paying to solicit your original work and that any referenced work must be cited as is required under the law. You understand that LGC are not paying for you to submit non-original work, and that the action of doing so will likely damage business operations, reputation and place LGC in breach of their own contracts with their clients.
The writer indemnifies LGC against losses arising from any provable breach relating to AI-related misrepresentation.
History of Usage
Further to the above you further declare that you have, to the best of your knowledge, not previously sub-contracted any work out to any third party nor have you used any LLM such as ChatGPT in providing your services to LGC.
Reporting
You confirm that if you are in breach of contract that you are to report any details to LGC within a period of thirty days on receipt of signing or reviewing this declaration.
You further confirm that you have been invited to share key details where you have previously subcontracted work out including to any LLM.
Permitted Use
LGC undertakes to restrict its use of LLM generated content exclusively and without exception when we submit work to our clients.
For the avoidance of doubt permitted use excludes any: writing, editing, drafting, rewriting, paraphrasing, summarising or outlining generated by any LLM.
Spellcheck tools such as Grammarly and non-generative AI tools are permitted . Transcription software such as Otter is permitted to transcribe interviews into text only.
If in doubt, writers are advised to request permission to use any LLM in any context.
Governing Law
This Declaration shall be governed by and understood in accordance with the laws of England and Wales, whose courts shall have exclusive jurisdiction.
Acceptance
Acceptance is confirmed either by ticking an acceptance box where provided, or, if any tick-box is not selected, by the act of continuing to provide any service to LGC.
Update to Terms
This Declaration may be updated from time to time to reflect changes in services, legal requirements, or industry. The current version will determine the Declaration which will be indicated by its effective date at the top of this page. You may be required to review and re-declare any commitment to this declaration but would be first requested to do so.
